If It’s Worth Promoting,
It’s Worth Protecting!™
The first step is to establish if your business has developed trademarks that CAN be protected.
Not all trademarks can be registered. There is no point in spending money trying to register trademarks that are unregistrable.
Most firms will charge you at least $300 for a similar report.
We will conduct a registrability search, analyze the results and provide you with our opinion, ABSOLUTELY FREE.
Fill out the form and find out, with no obligation to buy.
After you fill out the form above, watch your inbox for an email with a confirmation link. Make sure you click it and schedule the time for the phone call during which a Trademark Factory® representative will walk you through your trademarkability report and answer any questions you may have.
Generally, here is how our process works:
1. We start with identifying what names, logos and slogans you use in your business to attract customers.
Check out these videos that will make it easier to understand what can be trademarked, and whether or not it is a good idea to file so-called combined trademarks in a single application:

Combined Trademarks - File Separately or Together?
2. We then look at the provisions of the Trade-Marks Act and filter out those name, logos and slogans that do not meet its requirements. For example, if you are using the name "Toronto Cupcakes" to sell cupcakes in Toronto, you wouldn’t be able to trademark it.

3. Finally, we search through the database of registered trademarks and make sure that there are no other prior registrations for an identical or confusingly similar trademark.
Whether you should register your trademarks is a separate question that you would answer as part of deciding on your trademarking strategy. It’s also something we will be able to help you with during the call.
