Feds seek to seize trademark to the Mongol biker gang's notorious logo
Andrei Mincov's commentary on the original article
It's bad enough when the government is trying to take away someone else's property. What's worse is that in the case of registered trademarks, this is nothing but a symbolic act. Let's say, they do take away the trademark. The government can't really own it, because it would be canceled for non-use (unless the government itself is going to actually run a motorcycle club). If they simply cancel the registration, then the club can still enforce their common-law rights in the logo. So not only is this bad policy, but it's also mean and inefficient. Taxpayers' money could be spent on something more useful, for sure.
